Terms governing access to and use of the miaIA.AI platform for managing WhatsApp Business accounts. Last updated: 9 August 2026.

These terms govern the contractual relationship between Pablo Arce Marí, with tax ID (NIF) 26744726G and address at Calle 231, 2, Pta. 15, La Cañada, 46182 Paterna (Valencia), Spain (hereinafter "miaIA.AI" or "the Provider"), and the natural or legal person who contracts its services (hereinafter "the Client").
miaIA.AI operates as a Meta technology provider (Tech Provider) and makes available to the Client a business messaging platform for connecting and managing WhatsApp Business accounts through Meta's official API, including receiving and sending messages, managing the inbox and integrating with the Client's management tools.
As an auxiliary function, the platform includes automated text processing for specific customer service tasks (classifying enquiries, extracting data from a request and suggesting or sending replies), always within the flows that the Client itself configures. The platform does not offer or provide access to general-purpose artificial intelligence assistants through WhatsApp, in accordance with the WhatsApp Business Platform terms.
miaIA.AI is not Meta Platforms and does not act on its behalf. The availability and terms of the WhatsApp Business API are Meta's responsibility and may change at Meta's discretion.
To use the platform, the Client must create an account and connect its WhatsApp Business account, providing truthful, complete and up-to-date information. The service may only be contracted by legal entities and professionals acting in the course of their business; it is not intended for consumers or minors.
The Client is responsible for keeping its access credentials safe and for all activity carried out from its account. It must notify contacto@miaia.ai without delay of any unauthorised use or security incident it becomes aware of.
The Client undertakes to use the platform in accordance with applicable law and Meta's policies. In particular, the Client undertakes to:
Breach of these obligations may lead to immediate suspension of the service, as well as restriction or blocking of the account by Meta, a decision over which miaIA.AI has no control.
The billing model distinguishes two separate items:
Consequently, per-conversation or per-message rates are set by Meta and may change without notice at Meta's discretion. Any issue relating to billing for message usage must be handled with Meta. Subscription fees are stated exclusive of VAT, which will be added where applicable.
Non-payment of the subscription entitles miaIA.AI to suspend access to the platform after notifying the Client.
The Client is the controller of its end users' personal data, and miaIA.AI acts as processor under Article 28 of the GDPR, as detailed in the Privacy Policy. The Client is responsible for:
miaIA.AI provides the service with reasonable diligence, but does not guarantee that the platform will be available without interruption or free of errors, as it depends on third-party services (in particular Meta's WhatsApp Business API) and on connectivity infrastructure.
miaIA.AI is not liable for: interruptions, policy changes, restrictions or account blocks decided by Meta; the content of messages sent by the Client; the Client's use of the platform in breach of these terms; or indirect damages, loss of profit or loss of business opportunities.
In any event, save in cases of wilful misconduct or gross negligence, miaIA.AI's total liability to the Client is limited to the amount of subscription fees actually paid by the Client in the three months before the event giving rise to the claim. Nothing in this clause excludes liability that cannot be limited under applicable law.
The contract lasts for the subscription period contracted and renews automatically for equal periods, unless either party gives notice to the contrary before the renewal date.
The Client may terminate the contract at any time from the platform or by notifying contacto@miaia.ai, without penalty and with effect from the end of the current period. miaIA.AI may terminate the contract for serious breach by the Client, for non-payment or if it ceases to provide the service, in the latter case with reasonable prior notice.
After termination, the Client no longer has access to the platform and its data is deleted as set out on the data deletion page. The Client may request an export of its data before the effective termination date.
These terms are governed by Spanish law. For any dispute arising from their interpretation or performance, the parties expressly submit to the Courts of Valencia (Spain), waiving any other jurisdiction that might otherwise apply.
miaIA.AI reserves the right to amend these terms to reflect legislative or technical changes or changes to Meta's policies. Substantial changes will be notified to the Client reasonably in advance of taking effect.
